Bankruptcy – When Is It Time To Get Off The Fence?

Making the decision to get off the fence can be difficult.  Honestly, most of my bankruptcy clients stay on the fence until the last possible second.

How can you know when it is time to file bankruptcy?

If you are thinking about getting out of a jam by borrowing against your 401k, don’t do it until you talk with a bankruptcy attorney first.  Your 401k is a protected asset.  Don’t waste your 401k retirement paying on debts that you eventually will have to file bankruptcy against.

Garnishment

In Georgia, a creditor can take up to 25% of your net paycheck.  If you take home $4,000 per month, a creditor can get $1,000 of it.  When it comes to debt collection, Georgia is rough on debtors.

If your employer messes up the collection of the garnishment, they can be held liable for the entire amount of the debt!

In addition to garnishing your wages, a judgment creditor can clean out your checking out.  If you are facing a possible garnishment, it may be time to file right now.

The worst thing you can do is ignore the problem.  The problem won’t go away by itself.

Foreclosure

A Chapter 13 can stop the foreclosure of your home.  In a Chapter 13, we can take all of the back payments on your house and spread them out in your plan.

If you wait until after the foreclosure date, you have waited too long.

If a foreclosure date has already been set for your house, get to my office as soon as you can.  Sitting on the fence while you are facing a foreclosure is not a good idea.

Auto Repossession

Chapter 13 can stop the repossession of your car.

What are you going to do if you sit on the fence too long?  How will you get to work?
